Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the NxtGuest mobile application and website (the "Service") operated by Hwa Labs, LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

NxtGuest is a turnover coordination platform for short-term rental hosts. The Service automatically detects turnovers from calendar feeds (Airbnb, VRBO, Booking.com), coordinates cleaning assignments, sends SMS notifications to cleaning professionals, and tracks completion with photo verification.

2. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

3. User Roles

Hosts: Property owners or managers who add properties, connect calendar feeds, add cleaning professionals, and manage turnover assignments.

Cleaners: Cleaning professionals added by hosts. Cleaners interact with the Service primarily via SMS text messages and optionally through the mobile app.

4. SMS Messaging Terms

By being added as a cleaner on NxtGuest, you consent to receive automated SMS text messages related to cleaning assignments, briefings, reminders, and service notifications from NxtGuest.

• Message frequency: Varies based on cleaning activity. Typically 2-10 messages per active cleaning day.
• Message and data rates: Standard message and data rates from your wireless carrier may apply.
• Opt-out: Reply STOP to any message to stop receiving texts. You may also text STOP at any time.
• Help: Reply HELP for assistance or contact your host directly.
• No marketing: We do not send promotional or marketing messages. All SMS messages are transactional and related to cleaning coordination.
• Supported carriers: Compatible with all major US wireless carriers.

5. Subscriptions and Billing

The Service offers a 30-day free trial with full features. After the trial period:

• Your first property is free forever
• Additional properties are $7 per property per month
• Subscriptions are billed through Apple's App Store
• You may cancel your subscription at any time through your App Store settings

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Send spam, marketing messages, or unsolicited communications through the Service
• Attempt to interfere with or disrupt the Service
• Provide false or misleading information
• Use the Service to harass, abuse, or harm others
• Reverse engineer or attempt to extract the source code of the Service

7. Property and Calendar Data

You are responsible for ensuring you have the right to connect calendar feeds to the Service. We access calendar data (iCal feeds) solely for the purpose of detecting turnovers and coordinating cleaning assignments. We do not share calendar data with third parties except as necessary to operate the Service.

8. Cleaner Relationships

NxtGuest facilitates coordination between hosts and cleaners but does not establish an employment relationship between them. Hosts are responsible for their own agreements with cleaning professionals regarding compensation, insurance, and working conditions.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
